FEES AND PAYMENT

A 50% non-refundable deposit is required to secure the booking. For clarity, non-refundable because upon booking, the Photographer will refuse other bookings for that day/period. The balance must be paid before any photos will be released. Any additional hours will be billed at $250 AUD per hour as overtime; again, paid in full before any photos are released.

DELAYS AND OVERTIME

Shooting time begins at the agreed scheduled time. Delays are not the issue of the Photographer and time on set/site will be counted whether the Photographer is shooting or waiting for the Client. Overtime begins as soon as the agreed time has lapsed.

INTELLECTUAL PROPERTY

All images remain the copyright of the Photographer under Australian Copyright Law. The Client is granted a limited license that will specify and be limited to personal or commercial use. The Client may not profit from or reproduce the images without express written permission and is bound by the contractual period expressed by the contract.

USE OF THE IMAGES

Use of the images will be specified by the contract and includes their use on social media. Posting content created by the Photographer is permitted by and limited to the Client. Content created by the Photographer and posted by other Parties not specified by the contract constitutes a breach of contract and the Parties are liable under Australian Law.

MODEL RELEASE

The Model grants the Photographer the right to use images for promotional purposes including website, social media, and marketing materials, unless explicitly declined in writing before the session. The Model consents to being photographed/recorded and grants the Photographer (and the named Client, if any) a non-exclusive, worldwide, royalty-free licence to use the Model’s image, likeness, and voice as captured in the content from the shoot, solely for the permitted uses and for the term specified by the contract. The licence includes the right to edit, crop, retouch, combine, and caption the content, provided use stays within the permitted uses. The content will not be used in a way that is defamatory, unlawful, pornographic, misleading or deceptive, or that implies the Model personally endorses a product/service without separate written approval.

DELIVERY OF THE IMAGES

Edited images will be delivered within 2 weeks (4 weeks for weddings) of the session. Images will have basic edits including colour correction, cropping, and minor retouching. Requests for additional edits may incur additional charges.

LIABILITY & FORCE MAJEURE

The Photographer is not liable for events beyond their control such as accidents, illness, or weather that prevent completion of services. In such cases, efforts will be made to reschedule or refund any applicable amounts. The Photographer holds and may be required to evidence Public Liability Insurance and Professional Indemnity Insurance.

CLIENT RESPONSIBILITIES

The Client agrees to communicate clearly about expectations, arrive to the shoot on time, and provide necessary access or support as required. Late arrivals reduce shooting time and will still incur full charges and roll to overtime rates after the agreed period. The Client is responsible for other contractors on set/site and issues arising that impede the Photographer from performing their duties are the responsibility of the Client.
